The personal information you provide to the OWNER during the ordering and registration process is used for the OWNER internal purposes only. The OWNER uses the information it collects to learn what you like and to improve the SOFTWARE. Except as otherwise expressly permitted by this EULA or as otherwise authorized by you, the OWNER will not give any of your personal information to any third party without your express approval except as reasonably required by law, as authorized by this provision or as necessary to protect the OWNER and its agents. the OWNER can (and you authorize the OWNER to) disclose any information about you to private entities, law enforcement agencies or government officials, as the OWNER, in its sole discretion, believe necessary or appropriate to investigate or resolve possible problems or inquiries, or as otherwise required by law.

You agree that the OWNER may communicate with you via email and any similar technology for any purpose relating to the SOFTWARE, other OWNER's products and any services or SOFTWARE which may in the future be provided by the OWNER or on the OWNER's behalf. If you do not want to receive communication from the OWNER, you can unsubscribe at any time following the instructions contained in any email received from the OWNER or by writing an opt-out request to the OWNER at support@retouch4.me

3. Statistics
In order to innovate and continuously improve its products, the OWNER may collect some usage statistics from its SOFTWARE including, without limitation, the collection of information on how SOFTWARE is used by USERS.

4. Cookies
We use technology such as "cookies" to collect information and store your online preferences. Cookies are small pieces of information sent by a web server to a web browser, which allows the server to uniquely identify the browser on each page. We also use third party cookies, such as Google Analytics and Facebook Pixel.

Please note that refusing cookies does not mean you will no longer receive online advertising. It does mean that the company or companies from which you opted out will no longer deliver adverts tailored to your web preferences and usage patterns, so you may see a greater number of adverts that are irrelevant to you and your preferences.

1. The SOFTWARE is delivered electronically via the Internet only. We do not deliver the SOFTWARE on CD's via post mail.
2. After purchasing the SOFTWARE will be available at the USER's personal account on the website retouch4.me.

The OWNER does not make a refund for the SOFTWARE after the USER generates a registration key. These Terms of Service ("Terms", "Terms of Service") govern your use of our website located at retouch4.me (together or individually "Service") operated by RELU OÜ.

The fact of the USER purchase confirms that the USER is familiar and satisfied with the functionality of the SOFTWARE and agree to the terms of EULA. The OWNER does not make a refund for the SOFTWARE after the USER generates registration key. Before making a decision about buying the SOFTWARE the USER can download, install, and test the SOFTWARE DEMO.


6. Content
Content found on or through this Software and Service are the property of RELU OÜ or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.


7. Prohibited Uses
You may use Software and Service only for lawful purposes and in accordance with Terms. You agree not to use Software and Service:
0.1. In any way that violates any applicable national or international law or regulation.
0.2. For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.
0.3. To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "Spam," or any other similar solicitation.
0.4. To impersonate or attempt to impersonate Company, a Company employee, another user, or any other person or entity.
0.5. In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
0.6. To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of Software and Service, or which, as determined by us, may harm or offend Company or users of Software and Service or expose them to liability.
Additionally, you agree not to:
0.1. Use Software and Service in any manner that could disable, overburden, damage, or impair Software and Service or interfere with any other party's use of Software and Service, including their ability to engage in real time activities through Software and Service.
0.2. Use any robot, spider, or other automatic device, process, or means to access Software and Service for any purpose, including monitoring or copying any of the material.
0.3. Use any manual process to monitor or copy any of the material on Software and Service or for any other unauthorized purpose without our prior written consent.
0.4. Use any device, software, or routine that interferes with the proper working of Software and Service.
0.5. Introduce any viruses, Trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.
0.6. Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of Software and Service, the server on which Service is stored, or any server, computer, or database connected to Service.
0.7. Attack Service via a denial-of-service attack or a distributed denial-of-service attack.
0.8. Take any action that may damage or falsify Company rating.
0.9. Otherwise attempt to interfere with the proper working of Software and Service.

We may use third-party Service Providers to monitor and analyze the use of our Service.


9. No Use By Minors
Software and Service are intended only for access and use by individuals at least eighteen (18) years old. By accessing or using Software and Service, you warrant and represent that you are at least eighteen (18) years of age and with the full authority, right, and capacity to enter into this agreement and abide by all of the terms and conditions of Terms. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

Software and Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of RELU OÜ and its licensors. Software and Service is protected by copyright, trademark, and other laws of and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of RELU OÜ.


12. Copyright Policy
We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on Service infringes on the copyright or other intellectual property rights ("Infringement") of any person or entity.
If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to support@retouch4.me, with the subject line: "Copyright Infringement" and include in your claim a detailed description of the alleged Infringement as detailed below, under "DMCA Notice and Procedure for Copyright Infringement Claims"
You may be held accountable for damages (including costs and attorneys' fees) for misrepresentation or bad-faith claims on the infringement of any Content found on and/or through Service on your copyright.

You acknowledge and agree that: (i) you shall not retain, acquire or assert any intellectual property right or other right, title or interest in or to the Feedback; (ii) Company may have development ideas similar to the Feedback; (iii) Feedback does not contain confidential information or proprietary information from you or any third party; and (iv) Company is not under any obligation of confidentiality with respect to the Feedback. In the event the transfer of the ownership to the Feedback is not possible due to applicable mandatory laws, you grant Company and its affiliates an exclusive, transferable, irrevocable, free-of-charge, sub-licensable, unlimited and perpetual right to use (including copy, modify, create derivative works, publish, distribute and commercialize) Feedback in any manner and for any purpose.

If you wish to terminate your account, you may simply discontinue using Software and Service.
All provisions of Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

These Terms shall be governed and construed in accordance with the laws of EU, which governing law applies to agreement without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Software and Service and supersede and replace any prior agreements we might have had between us regarding Software and Service.

We will not be liable if for any reason all or any part of Software and Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of Software and Service, or the entire Software and Service, to users, including registered users.

1. ACCEPTANCE OF THE EULA
This EULA is considered accepted by the USER in case of the order, payment or receipt from the OWNER or authorized third-party non-exclusive rights to use the SOFTWARE under this EULA indicates your acceptance of the terms of this EULA.

2. LICENSE
The OWNER grants the USER a license to use (including commercial purposes) one copy of the SOFTWARE on the USERs' computers in an amount of not more than three. "USER" means company, entity or individual whose funds are used to purchase the SOFTWARE. Commercial use of the SOFTWARE, implemented by academic licenses for educational institutions is prohibited. "USE" means storing, loading, installing, executing or displaying the SOFTWARE. The USER has the right to remove the SOFTWARE at any time. To remove the SOFTWARE the USER need to transfer the SOFTWARE folder to the Trash or delete it. The USER may not modify, decompile, disassemble or otherwise modify the components of the SOFTWARE, except within the setting of the SOFTWARE's functions. The USER has the right to make a copy of the SOFTWARE that can be used only for archival purposes. The SOFTWARE should not be given for rent, rented or transferred to other persons. You may not make or distribute copies of the Software, or electronically transfer the SOFTWARE from one computer to another or over a network. The SOFTWARE cannot be used on virtual machines without the Owner's written permission. Virtualization technology may not be used to bypass other licensing terms and restrictions. The SOFTWARE cannot be used to create automated services, bots, Telegram-bots, and similar public services, without the written permission of the OWNER. You agree and accept that the OWNER may use license tracking mechanisms and metrics to prevent any violation of this Agreement. The license tracking mechanisms and metrics may use your internal network and internet connection. The license prohibits any use of the SOFTWARE, which violates international or local laws. Any unauthorized use will result in immediate and automatic termination of this EULA, and may, therefore, result in a lawsuit.

3. QUALITY ASSESSMENT
The USER is entitled to use the SOFTWARE DEMO without registration to assess the effectiveness of the SOFTWARE. The SOFTWARE DEMO allows to view before purchasing a SOFTWARE working tools and see the edited image. If the USER wants to save the image / apply effect to the image layer, the SOFTWARE must be acquired. Thus, the USER is given theopportunity to assess the effectiveness and functionality of the SOFTWARE before buying it. This approach ensures that the USER is satisfied with the SOFTWARE work.

4. REFUND POLICY

5. OWNERSHIP
The SOFTWARE is owned and copyrighted by the OWNER. Your license confers no title or ownership in the SOFTWARE and should not be construed as a sale of any right in the SOFTWARE.

6. COPYRIGHT
All exclusive rights, including copyright on the SOFTWARE, assignee, and are protected by the OWNER and international copyright treaties, as well as other laws related to intellectual property and contracts.

7. NO OTHER WARRANTIES
The OWNER does not warrant that the SOFTWARE is error free. The OWNER disclaims all other warranties with respect to the SOFTWARE, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and
noninfringement of third party rights. Some jurisdictions do not allow the exclusion of implied warranties or limitations on how long an implied warranty may last, or the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights and you may also have other rights which vary from jurisdiction to jurisdiction.

8. NO LIABILITY FOR CONSEQUENTIAL DAMAGES
In no event shall the OWNER or its suppliers be liable to you for any consequential, special, incidental or indirect damages of any kind arising out of the delivery, performance or use of the SOFTWARE, even if the OWNER has been advised of the possibility of such damages. In no event will the OWNER's liability for any claim, whether in contract, tort or any other theory of liability, exceed the license fee paid by you, if any.

9.3 Statistics
In order to innovate and continuously improve its products, the OWNER maycollect some usage statistics from its SOFTWARE including, without limitation, the collection of information on how SOFTWARE is used by USERS.

10. GENERAL PROVISIONS
This EULA between the USER and the OWNER supersedes any prior agreements or contracts, in any form (written or oral) relating to the EULA. If any part of EULA will be recognized by a court to be invalid, it will not affect the validity of the remaining parts of the EULA, which shall remain valid and enforceable according to its terms. This EULA will be automatically terminated in the event of non-compliance with its terms. The OWNER shall be entitled at its discretion to change this EULA in writing at any time. In the event of invalidity of any provision of this EULA, the parties agree that the invalidity of one part does not affect the validity of the other parts.
Note: All images used to demonstrate the capabilities of the SOFTWARE are the property of their respective authors. The OWNER uses them only for his private collection. Any images posted on the program website may be deleted at the request of the author.
